Mark S. Warshavsky CPA/ABV/CFF, CVA, CBA, ASA, CFE, MAFF, DABFA, MBA, is an independent arbitrator and mediator, and has achieved multi-faceted credentials delineated below. His unique and multi-disciplined background affords him the ability to assist litigants and fellow arbitrators to analyze and interpret the alleged financial claims introduced in conjunction with considering the evidence presented.

Mr. Warshavsky has been retained as an arbitrator and mediator in large, complex financial disputes since 2004 due to his diversified background in financial and legal issues. He also serves as an Arbitrator and Mediator for the American Arbitration Association's (AAA) National Roster of Arbitrators & Mediators, a leading provider of Alternative Dispute Resolution Services, and is an Associate Member of the American Bar Association’s Litigation and ADR sections. The AAA roster of large complex case panel arbitrators is comprised of recognized leaders in specific industries, all with advanced skills in dispute management techniques, each of whom is uniquely qualified to handle any type of large complex case.

Mr. Warshavsky is a nationally recognized testifying financial expert, an occupation he commenced in the 1980s, and has been retained in over 800 cases as a financial expert providing services as an expert witness, court appointed or agreed upon neutral expert, arbitrator, and mediator.

He has attained the following licenses and certifications: Certified Public Accountant (CPA), Accredited in Business Valuation (ABV), Certified in Financial Forensics (CFF), Certified Valuation Analyst (CVA), Certified Business Appraiser (CBA), Accredited Senior Appraiser (ASA), Certified Fraud Examiner (CFE), Master Analyst in Financial Forensics (MAFF), Diplomat of the American Board of Forensic Accounting (DABFA), Masters in Business Administration (MBA), and a Licensed Private Investigator in the states of New York and Florida.

  • Retained as a financial expert in over 800 assignments as a financial expert witness, court appointed or agreed upon neutral expert, and arbitrator or mediator.

  • Sub-specialty in all aspects of financial damages and lost profits in dispute resolution cases in diverse industries. Include firsthand participation in the legal aspects of a case focusing on financial interpretation of damages claims in the context of accounting, forensic accounting, and business valuation.

  • Successfully integrates legal knowledge in complex commercial dispute resolution with proficiency as a CPA, forensic accountant, and business evaluator in financial damages and lost profits cases.

  • Direct training in financial damages and lost profits analysis and models leading to receipt of a Master Analyst in Financial Forensics (MAFF) certification. Instruction in methodologies and approaches that includes financial investigative and forensic accounting techniques utilized in calculating damages.

  • Knowledgeable in the legal aspects of complex commercial dispute resolution through the reading of case law applicable to retained engagements spanning many years, education in commercial law through study of legal textbooks, as well as knowledge acquired through retention as a national recognized financial expert in hundreds of complex cases.

  • Combined experience in financial damages cases as a party-retained expert, witness, neutral independent expert engaged by courts to evaluate reports of both parties’ experts and service as an arbitrator.

This award is presented annually to an individual who has demonstrated exemplary character, leadership, and professional achievements in the industry.
